Confirmation of Alcohol and/or Drug Rehabilitation

If one of your offenses includes either a DUI charge or any conviction related to the use, possession or trafficking of prohibited drugs, it is very important to produce documented evidence proving that you have not used any of these substances, with which you were previously charged, over the past 12 months.

A negative test result for the use of any substance is given when the level found in a hair sample, which Viaguard Laboratories analyzes, is below the limits established by regulatory agencies.

Viaguard Laboratories (a leading alcohol and drug forensic testing facility), whose work is accepted by courts and legal authorities, will arrange to have a small sample of your hair tested, and the results will be made confidentially available to you.

We strongly recommend that a negative drug and/or alcohol usage test covering the previous 12 months be submitted as evidence of your rehabilitation. This legal report provides compelling evidence that may facilitate Parole Board approval of your application.

The cost of this testing, approximately $175, may be a worthwhile investment.

Rehabilitation

AN IMPORTANT AND EXCLUSIVE HARTEN OPTION

You are not required to complete rehabilitation instruction. However, in Pardon, Record Suspension, and U.S. Waiver applications, decision-making authorities often give preference to applicants who provide documented evidence of rehabilitation.

Harten now offers an intensive, optional criminal rehabilitation course that can be completed at your convenience, either in person or online.

Upon successful completion, you will receive a certificate confirming your participation. Including this certificate with your application demonstrates your commitment to rehabilitation and responsible citizenship. The course will not delay your application and may assist in expediting its approval.

Optional Course Fee: $100.00

You will receive an official certificate upon completion of the course. A copy of this certificate can be submitted as supporting documentation with your application.

Why Apply for a Pardon / Record Suspension?

A criminal record can limit where you can work, volunteer, travel, and live. It may affect many aspects of your personal, social, and economic well-being. Anyone convicted of a criminal offence will have a criminal record.

Many people are unaware that once they have been fingerprinted and charged—even if the charges were later withdrawn, they were acquitted, or they received an absolute or conditional discharge—they may still have a non-conviction criminal record that could prevent them from successfully passing a police background check.

The Board is an independent administrative tribunal with exclusive authority to grant, deny, or revoke Record Suspensions under the Criminal Records Act and the Criminal Code of Canada.

Grounds of Compassion

Harten will review your eligibility under the Royal Prerogative of Mercy (RPM).

The Royal Prerogative of Mercy is an exceptional remedy available in Canada in cases where justice, compassion, and humanitarian considerations justify special relief. It is generally granted upon the recommendation of the Minister of Public Safety or another authorized Minister.

Expungement Services

A criminal record file may exist even in situations where there was no conviction, including:

Summary Offences

For most summary offences, you may apply for a Record Suspension five (5) years after completing your sentence and all related penalties.

To help prepare your application in advance, Harten recommends beginning the process approximately one year before you become eligible.

 

Typical Summary Offences Include

  • Fraud or Theft Under $5,000
  • Failure to Appear
  • Breach of Probation

Indictable Offences

A Record Suspension is generally available 10 years after the completion of your sentence and all related penalties. Harten recommends beginning the application process approximately one year before you become eligible.

Typical Indictable Offences Include

  • Robbery
  • Possession for the Purpose of Trafficking
  • Fraud or Theft Over $5,000
  • Break and Enter
  • Aggravated Assault or Sexual Assault
  • Manslaughter

What Happens to Your Criminal Record?

Once a Record Suspension is granted, your criminal record is removed from the searchable Canadian Police Information Centre (CPIC) database, generally within 30 days.

The Parole Board of Canada issues directives to federal agencies, including the RCMP, to implement the Record Suspension.

Local police agencies are generally instructed to update their records within approximately 90 days, and eligible court records are sealed in accordance with applicable legislation.


U.S. Waiver

A Canadian Record Suspension does not remove your information from the databases maintained by U.S. Customs and Border Protection (CBP) or the U.S. Department of Homeland Security.

Your information may remain on file for reasons including:

  • Previous criminal charges or convictions in Canada
  • Prior immigration violations
  • Illegal entry into the United States
  • Unauthorized employment in the United States

Because U.S. government records are confidential, there is no guaranteed method of determining what information is contained in their databases.

While U.S. Customs officers may exercise discretion for certain minor offences, admission to the United States always remains at the discretion of the inspecting officer unless an official U.S. Entry Waiver has been granted.

Certain offences involving moral turpitude, including drug offences, fraud, robbery, arson, blackmail, and similar crimes, will generally require a U.S. Entry Waiver before travel.
